Terms of Service

These Terms of Service govern your use of MARKEWORK.com (the "Platform"), operated by Filip Konecny Enterprises, s.r.o., IC: 22176942, DIC: CZ22176942, with registered office at Cujkovova 1714/21, 700 30 Ostrava - Zabreh, Czech Republic.

1. Scope of Services

The Platform connects companies and marketing freelancers. We provide discovery, profile, listing, and application tooling. We are not a party to contracts formed directly between users.

2. Account Types and Plans

By creating an account, you agree to provide accurate and up-to-date information.

• Free marketer account: up to 5 tokens per monthly cycle and no public freelancer profile publication.
• Paid accounts: plan features depend on selected tier (Basic, Gold, Unlimited) and active billing.
• Plan changes, token consumption, and upgrade eligibility are subject to the Platform rules visible in your account.

3. Tokens

Tokens are a usage unit for selected platform actions. Token costs are shown in context. Token balances, monthly grants, and limits differ by plan type. Tokens are non-transferable and have no cash value.

4. Subscriptions and Billing

• Paid memberships are billed monthly unless stated otherwise at checkout.
• Subscriptions renew automatically until canceled.
• Cancellation takes effect at the end of the current billing period unless otherwise required by law.
• Payment processing is handled by external providers (for example, Stripe).

5. Consumer Withdrawal (EU/EEA)

If you are a consumer in the EU/EEA, you may have a statutory right to withdraw from a distance contract within 14 days, subject to legal exceptions for digital services. Details are available in our Refund and Withdrawal Policy.

6. User Conduct

You agree not to:

• Provide false, misleading, or unlawful content.
• Infringe third-party rights, including intellectual property and privacy rights.
• Use the Platform to spam, scrape, abuse, or disrupt service integrity.

7. Content and Rights

You retain rights to content you upload, but grant us a non-exclusive license to host, process, and display it for platform operation. You are responsible for ensuring you have all necessary rights to submitted content.

8. Availability and Changes

We may modify, suspend, or discontinue parts of the Platform for maintenance, security, or business reasons. We may update these Terms as required.

9. Limitation of Liability

To the maximum extent permitted by law, the Platform is provided "as is" without guarantees of uninterrupted availability, specific results, or successful matches. Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.

10. Governing Law and Jurisdiction

These Terms are governed by Czech law, without prejudice to mandatory consumer protections in your country of residence within the EU/EEA.
